Terms of Service

1. Service Description

Scaile provides on-demand GPU compute environments for AI and machine learning workloads. Users purchase prepaid credits and spend them on GPU time billed per minute. Scaile provisions infrastructure from third-party cloud providers on your behalf. GPU availability and pricing are dynamic and depend on real-time supply from our provider network. Nothing is guaranteed until an instance is successfully provisioned.

2. Eligibility

You must be at least 18 years old to use Scaile. By creating an account, you represent that the information you provide is accurate and that you have the legal capacity to enter into this agreement. Each person may maintain only one account.

3. Account & Access

You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these terms.

4. Credits & Billing

Scaile uses a prepaid credit system. 1 credit = $1 USD. Credits are deducted per minute once a GPU is reserved for your instance, beginning at provisioning — not when the environment is fully ready. Pricing displayed on template and launch pages reflects current rates at the time of viewing and may change at any time based on provider pricing and GPU availability. The rate you are charged is the rate in effect at the moment your instance is provisioned, and that rate remains fixed for the duration of that instance. When your credit balance reaches zero, running instances are automatically stopped. Stopped instances continue to incur storage charges. If your balance is depleted, stopped instances may be permanently destroyed along with all associated data.

5. Refund Policy

All credit purchases are final and non-refundable. Credits remain in your account until used and do not expire. If you experience a verifiable platform error that resulted in unintended charges, you may contact [email protected]to request a review. Adjustments are made at Scaile's sole discretion and are not guaranteed.

6. Acceptable Use

You agree not to use Scaile to:

  • Mine cryptocurrency or perform proof-of-work computations
  • Store, process, or distribute illegal content
  • Launch denial-of-service attacks or abuse network resources
  • Resell, sublicense, or share access to your instances
  • Circumvent billing, metering, or usage limits
  • Reverse-engineer or probe Scaile infrastructure
  • Violate the acceptable use policies of our upstream GPU providers

We reserve the right to suspend or terminate accounts that violate this policy, with or without notice. Credits remaining in terminated accounts are forfeited.

7. Your Data

You own the data you create within your instances. Scaile does not access, monitor, or claim rights to your container contents, files, or outputs. When an instance is destroyed — whether by you, by credit exhaustion, or by storage balance depletion — all associated data is permanently deleted and cannot be recovered. You are responsible for downloading or backing up any data you wish to keep.

8. API Keys & Third-Party Services

Certain templates require you to provide your own API keys (e.g., Anthropic, OpenAI). These keys are injected into your container at launch and are not stored by Scaile. You are solely responsible for any charges incurred through third-party API providers. Scaile is not liable for third-party service availability, pricing changes, or data handling.

9. Availability & Uptime

Scaile is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted service, specific uptime percentages, or GPU availability. GPU models, configurations, and pricing shown on the platform are indicative and subject to change based on real-time supply from our provider network. A GPU listed as available may become unavailable between the time you view the page and the time you launch an instance. Scaile will attempt to provision your requested configuration but cannot guarantee fulfillment. If provisioning fails, no credits are deducted. Infrastructure is provisioned from third-party providers and may be subject to capacity constraints, maintenance windows, or outages beyond our control. We will make reasonable efforts to notify you of planned maintenance.

10. Limitation of Liability

To the maximum extent permitted by law, Scaile's total liability for any claims arising from your use of the service is limited to the amount you paid to Scaile in the 12 months preceding the claim. Scaile is not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, lost profits, or business interruption, regardless of the cause of action.

11. Indemnification

You agree to indemnify and hold Scaile harmless from any claims, damages, or expenses arising from your use of the service, your violation of these terms, any content you create or store on the platform, or your violation of any third-party rights.

12. Termination

You may close your account at any time by contacting [email protected]. Remaining credits are non-refundable upon voluntary account closure. Scaile may suspend or terminate your account for violation of these terms. Upon termination for cause, any remaining credits are forfeited and all instances are destroyed.

13. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes via email or a notice on the platform. Continued use of Scaile after changes take effect constitutes acceptance of the updated terms. If you do not agree, you may close your account.

14. Governing Law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any disputes arising under these terms shall be resolved in the state or federal courts located in Delaware. For claims under $10,000, either party may elect to resolve the dispute in small claims court.
